The real reason why the Senate shouldn't take up a new Supreme Court appointment



The New York Times wasted no time in showing how quickly justices have been confirmed to the bench, pointing out that from the time of nomination to confirmation usually only a few months have passed. They do that to argue that the Senate should take up whatever nominee Obama puts before them to the Supreme Court.

At the Republican debate, candidates fumbled for an answer as to why the Senate should avoid approving an Obama Supreme Court nominee. "Well, uh... it's, like, an election year or something..."

I have a much better and more direct reason. The reason the Senate should avoid taking up an Obama Supreme Court nominee not because it's an election year, not because Obama only has 11 months left in office, but precisely because Obama is President. That's right; if almost anyone else were President, I believe the Senate should take up the nomination, but not in this case, because our President happens to be Barack Obama, and Obama is a lawless pirate who appoints judges who pervert the constitution and uphold his lawlessness.

Consider just a few examples of Obama's lawlessness.

1) He has modified Obamacare countless times without an act of Congress. For example, he gave Obamacare exemptions to unions who supported his campaign

2) Obama gave amnesty to illegal aliens via executive order, without an act of Congress. That clearly was a violation of the law.

3) Obama made illegal recess appointments when Congress wasn't in session.

4) Obama illegally claimed his treaty with Iran wasn't a treaty and didn't require a 2/3 vote for approval.

5) Obama has stopped enforcing immigration laws.

6) He's used the IRS to target conservative organizations

And so on. But what's worse, the judges he appoints usually uphold his lawlessness and subverting of the constitution. That's why I think there is a rational basis not for saying "We don't consider Supreme Court picks in an election year" but rather "We don't consider Obama's Supreme Court picks in an election year", because we don't want to pack the highest court with someone who supports such illegal acts. With Scalia's death the court is basically balanced 4-4; with one more liberal justice, many of our fundamental rights will be in jeopardy.

Rather than beating around the bush, we should be very honest about why Obama should be denied this right. Really, by all rights Obama should be impeached; at a minimum, he must not be allowed to appoint any more judges, and certainly not any more supreme court justices.
