Commie Judge calls right to work a confiscation of union property



A commie judge in Wisconsin struck down Wisconsin's right to work law, which prevents unions from forcibly collecting dues from employees who don't want to be members.

The commie judge had a novel theory, that the right to work law is an "economic taking" because it takes money that would otherwise belong to the union--the money of people who don't want to be associated with it.

Judge C. William Foust ruled today for two unions that challenged the 2015 law on the grounds that prohibiting them from collecting fees from non-members to cover their share of collective bargaining costs constituted a "taking" of private property without just compensation under the state constitution.

In his ruling, Foust argued that because a union "cannot decline exclusive representative status unless it declines to be voted in at a workplace to begin with," the union is effectively required to bargain on behalf of non-members as well as members.

Prohibiting the union from collecting fees from non-members, Foust elaborated in his decision, was at odds with the Wisconsin state constitution's provision that "the property of no person shall be taken for public use without just compensation." The services that unions must provide to non-members, Foust argued, constitute property.

So the commie judge said this is a "taking" because the right to work law prevent the unions from stealing money from people who want no part of it. I'll bet this commie judge never finds an "economic taking" where environmental regulations are concerned that prevent development of peoples' properties, or other regulations that increase the cost of doing business.

This is only a trial court ruling. This will undoubtedly be appealed to Wisconsin's highest court, which is run by conservatives, who don't usually twist laws meant to protect private property and use them to impose communism on its citizens.

There has been one article after the other in the press how delegates who are pledged to Donald Trump may actually be Ted Cruz supporters. That's because in many states the allocation of delegates is divorced from the actual voting. Say Trump wins 50% of the delegates in South Carolina. The voters do not actually pick the delegates, the South Carolina Republican party does. It picks delegates who promise to vote for Trump, but only on the first ballot. So what many state parties are doing is picking delegates who will vote for Trump on the first ballot, but on the second ballot, when they are free, will vote for Ted Cruz.
