Kansas judge, acting like dictator, threatens to shut down all schools


A judge in Kansas has threatened the state legislature, saying that if the state government did not redistribute more income to poorer school districts, that he would, by judicial fiat, shut down all schools in Kansas for the upcoming school year.

The struggle over school funding in Kansas reached a new crisis point when the State Supreme Court on Friday ruled that the Republican-dominated Legislature had not abided by its constitutional mandate to finance public schools equitably, especially poorer districts with less property wealth. The court, in an effort to force legislative action, reiterated a deadline that gave the state until June 30 to fix the problem or face a school shutdown.

Funding for schools is primarily funded by local, town property taxes. Any additional amounts from the state is supposed to be merely a supplement. To require the state to even out funding for each district is a redistribution of income from wealthy districts to poorer ones. In effect it is punishing wealthy districts for deciding to spend more on their own students, saying, "If you want to spend more on your own students, you have to spend more on students in 50 other districts as well." It's pure marxism and redistribution of wealth, and the judge is assuming dictatorial powers he does not have. There is no constitutional right, state or federal, to have the same level of education for every student.

Since school choice is still very limited, this is effectively about giving more money to failing schools. Why not instead of giving money to schools, give money to students in the form of vouchers, and let them decide where to go?

The article was full of sob stories about overcrowded classes and crumbling schools. The article doesn't say a word about impact of the influx of illegal aliens on the school system.

But if towns are unhappy with overcrowded classes, why don't they raise their own property taxes and send that money to schools? The article never addresses that either.
