Out of control judiciary orders "Dreamer" program restarted


One of Mark Levin's favorite sayings is that the Left never gives up. Levin says that if the Left loses the Presidency, they fight on in Congress. If they lose the Congress, they fight on in the Presidency. If they lose the Presidency and the Congress, they fight on in the courts, and if that doesn't work, they fight on in the bureaucracy.

And he's right. The latest example of this is a leftist judge in San Francisco who has ordered the "Dreamer" program restarted. President Trump stopped accepting new renewals for the Dreamer program months ago, on the grounds that the program was not legally created by Obama, since Obama didn't have Congressional authorization (you know, what we used to call "laws"), to grant such a sweeping amnesty to children of illegal aliens. You would think since the program is not based on a law, that a judge would find no way to reinstate that. But activist judges care nothing for the law, they make the law.

In a ruling Tuesday evening, San Francisco-based U.S. District Court judge William Alsup ordered the administration to resume accepting renewal applications for the Deferred Action for Childhood Arrivals program, better known as DACA.

Unless halted by a higher court, the ruling will allow former DACA recipients who failed to renew by an October 5 deadline a chance to submit renewal applications and will also require the administration to allow renewal of applications expiring in the future. The decision does not permit new applications for DACA status.

The Trump Administration could seek a stay of the ruling from the 9th Circuit Court of Appeals or the Supreme Court.

Don't expect the 9th Circuit to be any help, it's packed with far leftists. Trump would have to appeal this to the Supreme Court.

If the judge's order remains in place, it could also roil ongoing legislative efforts on DACA by undercutting the urgency many advocates have expressed, calling for legislation to be passed before large numbers of Dreamers begin losing their protected status in March.

That's right. Trump is attempting to use DACA as leverage to get a border wall built. But if this decision is upheld, Democrats won't have to make any concessions.

But perhaps Trump won't even appeal the decision. Trump has said he wants "a Bill of Love" to give amnesty to "Dreamers". He has said that he wants to pass whatever immigration bill passes the Congress, even if he doesn't like it.

Trump said he’d sign whatever immigration bill Congress could send him. “I’m not saying I want this or I want that. I will sign it,” he told the group.

Given Trump's flexibility, I would not be surprised to see him fail to appeal this decision. We have an out of control court system, a Congress which bows to the minority party, and a President who seems strangely disengaged on the key issue that got him elected president. I thought Republicans won this election at all levels; but it seems like the Democrats, or at least the Democratic point of view, is still firmly in charge.

Mark Levin is dead wrong when it comes to preserving local tax deductions


On his show last night Mark Levin spent a lot of time arguing with callers over the fairness of being able to deduct state and local taxes. The new tax bill put a $10,000 cap on state and local tax deductions and Levin, who probably pays the top rate of 5.75% in Virginia (plus property taxes), which, given his income, amounts to a lot more than $10,000, feels it is unfair not being able to deduct such payments from federal taxes.

After one year in office, the Treasury Department has 7.5% fewer employees. The Department of Education (which doesn't educate a single child), is 4.8% smaller. The Department of Labor (without a single laborer) is down 4.6%. The Department of State, which must do something, but I can't figure out what, has 3.8% fewer employees.
